Welcome to TheArtFolio. These Terms & Conditions ("Terms") govern your use of our website and the purchase of any products from us. Please read them carefully. By browsing this website or placing an order, you confirm that you accept these Terms and our Privacy Policy (set out below). If you do not agree, please do not use the site.

1. About these Terms

These Terms apply to every order you place with us and to your use of this website. We may update them from time to time to reflect changes in law or how we operate. The version that applies to your order is the one in force at the time you place it. We recommend you save or print a copy for your records.

2. Eligibility and your account

You must be at least 18 years old and able to enter into a legally binding contract to place an order. If you create an account, you are responsible for keeping your login details confidential and for all activity that takes place under your account. Please give us accurate, current and complete information, and keep it up to date. You may close your account at any time by contacting us.

3. Products and artwork

We sell original artwork, fine-art prints and photography, with options for mounts and framing. We take care to describe and picture our products accurately. However:

  • Colours and tones may appear slightly differently depending on your screen and settings, so on-screen images are a guide rather than an exact representation.
  • Prints are reproductions and may differ subtly from any original work. Where an item is part of a limited edition, the edition details are shown on the product page.
  • Framed and mounted items are made to order to the specification you select (size, frame, mount and mount colour). Because these are made specifically for you, different cancellation rules may apply — see section 7.
  • Natural materials such as wood frames may vary slightly in grain and tone.

All products are subject to availability. We may withdraw or change any product at any time.

4. Orders and our contract with you

When you place an order, you are making an offer to buy. We will send an order acknowledgement confirming we have received it — this is not acceptance. Our contract with you is formed only when we send a dispatch confirmation for the relevant item(s). If we cannot accept your order (for example, an item is out of stock, there is a pricing error, or we are unable to obtain authorisation for payment), we will let you know and will not charge you, or will refund any amount already taken.

We reserve the right to refuse or cancel any order at our discretion, including where we reasonably suspect fraudulent activity.

5. Pricing and payment

Prices are shown in pounds sterling (GBP) and, where applicable, include VAT at the prevailing rate. Delivery charges are shown separately at checkout before you confirm your order. Framing, mounts and other options may add to the price, as indicated on the product page.

We take reasonable care to ensure prices are correct. If we discover an error in the price of items you have ordered, we will contact you to ask whether you wish to continue at the correct price or cancel; we are not obliged to supply at an incorrect price.

Payment is taken through our payment providers at checkout. We do not store your full card details. You confirm that the payment method you use is yours (or that you are authorised to use it).

6. Delivery

We deliver to the addresses and regions shown at checkout. Estimated delivery times are provided in good faith but are not guaranteed, and made-to-order framed items may take longer to prepare. Risk in the products passes to you on delivery; ownership passes once we have received payment in full and the items have been delivered.

For international orders, you may be responsible for import duties, taxes and customs charges levied by the destination country. These are outside our control and are not included in the price or delivery charge.

If an item arrives damaged or an order is incomplete, please contact us within a reasonable time of delivery so we can put it right.

7. Cancellations, returns and refunds

If you are a consumer in the UK, you have the right to cancel most orders within 14 days of receiving them under the Consumer Contracts Regulations 2013, without giving a reason. To cancel, contact us at [CONTACT_EMAIL] with your order details. You then have a further 14 days to return the item.

To receive a full refund, items must be returned unused and in their original condition and packaging. We will refund the price you paid, including standard outbound delivery, within 14 days of receiving the item back (or evidence that you have sent it). You are responsible for the cost and safe return of the items unless they are faulty or not as described.

Made-to-order and bespoke items. The 14-day cancellation right does not apply to goods that are made to your specification or clearly personalised — this includes framed and custom-mounted pieces prepared specifically for you. This does not affect your legal rights if such items are faulty or not as described.

Faulty or misdescribed goods. Nothing in these Terms affects your legal rights under the Consumer Rights Act 2015, including your right to a refund, repair or replacement for goods that are faulty, not as described or not fit for purpose.

8. Intellectual property

All content on this website — including text, layout, graphics, logos and the TheArtFolio name — is owned by or licensed to us and is protected by intellectual property laws. The copyright in each artwork and photograph remains with the respective artist or rights holder. When you buy a product, you buy the physical item only; you do not acquire any rights to reproduce, copy, resell commercially, or create derivative works from the artwork. You may not reproduce, distribute or exploit any content from this site without our prior written permission.

9. Acceptable use

You agree to use the website only for lawful purposes. You must not misuse the site by introducing harmful material, attempting to gain unauthorised access, scraping or harvesting data, or interfering with its operation or security. We may suspend or restrict access if we reasonably believe these Terms have been breached.

10. Availability and liability

We aim to keep the website available but cannot guarantee it will be uninterrupted or error-free, and we may suspend, withdraw or restrict all or part of it for business or operational reasons.

We do not exclude or limit our liability where it would be unlawful to do so — this includes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. Subject to that, we are not liable for losses that were not foreseeable, or for business losses (we supply products for domestic and private use). Where we are liable to you, our total liability in connection with an order will not exceed the price paid for that order.

We are not responsible for delays or failures to perform caused by events outside our reasonable control (such as extreme weather, postal or carrier disruption, or supply failures); we will let you know and take reasonable steps to minimise the effect.

11. General terms

The website may contain links to third-party sites; we are not responsible for their content or practices. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in force. Our failure to enforce a right is not a waiver of it. These Terms are governed by the laws of England and Wales, and disputes are subject to the non-exclusive jurisdiction of the courts of England and Wales. If you have a complaint, please contact us first so we can try to resolve it.

12. Privacy Policy

This Privacy Policy explains how TheArtFolio collects, uses and protects your personal data when you use our website or buy from us. We are the "data controller" for this information. We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

What we collect

  • Identity and contact data — name, billing and delivery address, email address and phone number.
  • Order and transaction data — details of products you buy and payments (we do not store full payment card numbers).
  • Account data — login details and preferences, if you create an account.
  • Technical and usage data — IP address, device and browser information, and how you use the site, collected via cookies and similar technologies.
  • Marketing preferences — your choices about receiving marketing from us.

How we use it, and our lawful bases

  • To process and deliver your orders and provide customer service — to perform our contract with you.

Who we share it with

We share data only as needed to run our business: our e-commerce platform (Shopify), payment providers, delivery and framing partners, analytics and marketing service providers, and our professional advisers. We may also disclose information where required by law. We do not sell your personal data. Some providers may process data outside the UK; where they do, we rely on appropriate safeguards (such as UK-approved data transfer mechanisms).

How long we keep it

We keep personal data only for as long as necessary for the purposes above, including to meet accounting, tax and legal requirements, after which it is securely deleted or anonymised.

We use appropriate technical and organisational measures to protect your data. No transmission over the internet is completely secure, but we take reasonable steps to safeguard the information you provide.

Your rights

Under UK data protection law you have the right to access your data; to have it corrected or erased; to restrict or object to processing; to data portability; and to withdraw consent at any time.
